Photography Release Forms
I’m creating a childrens picture book (for profit). Property release/editorial photography questions.?

This is my first endeavor in self-publishing and I need some photos for my childrens picture book. If I understand this correctly, I’m going to be creating ‘editorial photos’…unless I use a photo for the cover or ad (those would be commercial photos.)
In the creation of my editorial photos, I can take pics withOUT a property release if the pic is a public location taken from a public place. (No identifiable persons.) I’ve read it’s a courtesy to ask for a release eventhough it’s not required.

If I take photos of a PRIVATE location, I need a PROPERTY release form filled out. I have a blank one I copied from a website. Do I have to provide the actual picture to them?

When approaching both PUBLIC and PRIVATE entities for their PROPERTY RELEASE, how do I go about doing this? Do I call and ask for the manager or public relations person? Do I email them a msg.? What is the best way to do this???

First off I’m no lawyer so take what I say with a grain of salt.

Editorial photos refers to the pics not being used for profit and more of a news story. You will still need a model release if its on the cover, in the center, or on the sleave of the book. Just get it to cover your bases. Local laws can vary so you may want to look up a local photography club and ask around.

You are correct that private property needs a release. Anything thats not owned by the community as a whole (park, public beach, library) is a public place. Stores and things owned by others are not. The local car wash, while being in plain public view, is still a private place since its not owned by the community.

As far as approaching people, just do it and act like you know what your doing. A phone call or face to face will usually be pretty persuasive. There’s alot of email scams out there and you will get better results by being personal.
