So i recently signed up to sell my images on iStock photo, and i read through all their nitty gritty terms of agreement and they state that “for every identifiable face you need a model release form before selling the image”. How is it that i need a model release form to sell pictures of myself and my friends, but paparazzi can snap away at unknowing celebrities and sell those pictures without the celebrities written consent?

The issue is that using a photograph of a person can be interpreted as an invasion of privacy.

Celebrities, as a consequence of their celebrity, have sacrificed the presumed right to privacy. In addition, the sleazy publications that purchase the output of the paparazzi simply budget for the legal expenses associated with using photographs without releases.

But legitimate purchasers of photography for purposes for advertising take a more cautious approach and proactively protect themselves from ‘models’ who claim invasion of privacy after the fact.

And by the way, a model release has nothing at all to do with copyright – with a few very special exceptions, the photographer always owns the copyright to the image regardless of whether people appear in the image and regardless of whether there is a signed model release.
